Giving People The Opportunity To Work In The United States

At The Law Office of Ana Y. Romero, PLLC, I assist employers and employees with obtaining employment-based nonimmigrant and immigrant visas. The exact visa you or your employee need will depend upon the specific nature of your/their work. I can help you determine which type of visa is required in your situation and can lead you through the steps required to secure it.

Common Types Of Employment-Based Visas

While there are many different kinds of employment-based visas, some are more common than others. Below are some of the types of visas that workers frequently need.

H-1B Visa

The H-1B visa is for skilled foreign workers in specialty occupations, typically requiring a bachelor’s degree or equivalent. This visa allows U.S. employers to temporarily employ foreign professionals in technology, science and engineering.

TN Visa

The TN visa is available to citizens of Canada and Mexico under the North American Free Trade Agreement (NAFTA). It allows professionals in certain occupations to work in the U.S. for a specific employer.

L-1 Visa

The L-1 visa is designed for intracompany transferees, allowing multinational companies to transfer employees from a foreign office to a U.S. office. It includes L-1A for managers and executives and L-1B for employees with specialized knowledge.

O-1 Visa

The O-1 visa is for individuals with extraordinary ability or achievement in science, arts, education, business or athletics. It is often sought by those at the top of their respective fields.

EB-1 Visa

The EB-1 visa is an employment-based immigrant visa for individuals with extraordinary ability, outstanding professors and researchers, or multinational managers and executives. It is designed for those who demonstrate exceptional achievements in their field.

EB-2 Visa

The EB-2 visa is for professionals with advanced degrees or exceptional ability in their field. It includes both advanced degree professionals and individuals with exceptional ability.

EB-3 Visa

The EB-3 visa is for skilled workers, professionals with bachelor’s degrees and unskilled workers (other workers). It allows U.S. employers to sponsor foreign workers for permanent residence.

PERM Labor Certification

The Program Electronic Review Management (PERM) process is a labor certification program that U.S. employers must complete to sponsor foreign workers for permanent residency through the EB-2 or EB-3 categories.
